This court having regularly acquired jurisdiction for the trial of the above-entitled cause submitted by both parties for decision,after consideration thereof by the Court upon the record, its decision and order for the judgment having been filed on the ________15th________day of June, A. D. nineteen hundred and _thirty-four;
By virtue thereof it is hereby adjudged and decreed that the order of the Court of the First Instance of Negros Occidental, dated the 30th day of September, nineteen hundred and thirty-two_, and from which the above-entitled appeal was taken, be, and the same is hereby, affirmed with the modification that the actual area of the land of the plaintiff, covered by the roof of the balcony of the defendant, i. e. 8.40 square meters, is the portion of the land of the former occupied by the latter, without costs.
It is further ordered that xx xx__________ xx__________ xx__________ recover from xx_ xx__________ xx__________ the sum of P__xx__, as costs.
